These Applicant Portal Terms & Conditions (“Terms”) govern your access to and use of Arizona Pain’s online careers site and applicant portal, including the submission of any job application through our third‑party applicant tracking system (“ATS”). By submitting an application through the Applicant Portal, you agree to these Terms as described in Section 2 below.
1. Scope / What These Terms Cover
These Terms apply only to the recruiting and hiring application process conducted through Arizona Pain’s online application experience (the “Applicant Portal” or “Portal”). These Terms do not apply to patient services, clinical communications, patient portals, or medical care.
2. Acceptance
By checking the box indicating your acceptance and clicking “Submit Application,” “Apply,” or a similar button (or otherwise completing the Portal submission workflow), you agree to be bound by these Terms.
If you do not agree, do not use the Portal or submit an application.
Version control. The version of these Terms presented at the time you submit your application will apply to that submission.
3. Eligibility and Authorized Use
You may use the Portal only to:
- apply for open positions at Arizona Pain; and/or
- communicate with Arizona Pain about your candidacy.
You agree not to use the Portal for any unlawful purpose or in any way that interferes with, disrupts, harms, or attempts to gain unauthorized access to the Portal or Arizona Pain’s systems.
4. No Offer / No Employment Contract
Submitting an application, receiving communications from Arizona Pain, or participating in interviews does not create an employment contract or guarantee employment. Any offer of employment must be in a written offer letter signed by an authorized representative of Arizona Pain.
5. Applicant Representations (Accuracy, Authorization, and Updates)
You represent and agree that:
- Accuracy. All information you submit is true, complete, and not misleading.
- Authorization. You are authorized to provide the information you submit (including any work samples) and it does not violate any third‑party rights or obligations.
- Updates. You will promptly update your application information if it becomes inaccurate during the hiring process (for example, licensure status, work authorization status, contact information).
- Appropriate content. You will not submit content that is unlawful, harassing, discriminatory, threatening, defamatory, or otherwise inappropriate.
Arizona Pain may remove you from consideration if you provide materially inaccurate or misleading information.
6. Do Not Submit Patient/Health Information
The Portal is not intended for patient communications or clinical information. Do not submit any patient data or protected health information (PHI) through the Portal.
7. Work Samples and Submitted Materials
If you provide writing samples, code samples, portfolios, presentations, or other materials (“Submitted Materials”):
- You retain ownership of your Submitted Materials.
- You grant Arizona Pain a limited, nonexclusive, royalty‑free license to use, reproduce, store, and share Submitted Materials internally (and with service providers supporting recruitment) solely for recruiting, evaluating your candidacy, and compliance/recordkeeping purposes.
Confidentiality warning: Do not submit materials containing confidential information belonging to a current or former employer or any third party unless you have written authorization to do so.
8. Screening, References, and Background Checks (Overview)
Arizona Pain may verify information you provide (such as employment history, education, licensure/certifications, and references) as permitted by law.
8.1 FCRA / Consumer Reports (Separate Documents)
If Arizona Pain obtains background checks through a third‑party consumer reporting agency (a “consumer report” under the Fair Credit Reporting Act), Arizona Pain will provide required disclosures and obtain required authorizations in separate documents (not within these Terms). You may be asked to review and sign those separate forms before a report is obtained.
8.2 Medical Inquiries and Testing
Where lawful, Arizona Pain may request or require job‑related screening steps (including drug testing) at an appropriate stage in the process. Arizona Pain will not request medical information in stages or manners prohibited by law.

10. Privacy and Data Processing
Arizona Pain’s collection and use of personal information submitted through the Portal is described in Arizona Pain’s Applicant/Recruiting Privacy Notice (the “Privacy Notice”), which is incorporated by reference.
If there is a conflict between these Terms and the Privacy Notice regarding personal information processing, the Privacy Notice controls.
11. Electronic Communications and Electronic Signatures
You consent to receive communications about your application electronically (for example, by email, Portal notifications, or text message if you provide a mobile number and opt in where required).
To the extent permitted by applicable law, your electronic acknowledgments, checkbox acceptances, and submissions may constitute an electronic signature.
12. Third‑Party ATS and Service Providers
The Portal may be hosted or operated by Arizona Pain’s third‑party ATS provider and may integrate with additional service providers (for example, scheduling tools, assessment providers, or email delivery services). Arizona Pain may share applicant information with such providers solely for recruiting, hiring, and related operational purposes, consistent with the Privacy Notice.
Your use of third‑party services may also be subject to their terms and policies. Arizona Pain is not responsible for third‑party services not under its control.
13. Account Security
If the Portal allows you to create an account:
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify Arizona Pain promptly of suspected unauthorized access to your account.
Arizona Pain may suspend or terminate access to the Portal if it reasonably believes your account is compromised or you have violated these Terms.
14. Prohibited Conduct
You agree not to:
- use bots, scrapers, scripts, or other automated means to access or submit through the Portal;
- probe, scan, or test Portal security or attempt to bypass authentication;
- upload malware or interfere with the Portal’s operations;
- impersonate any person or misrepresent your identity;
- submit abusive, discriminatory, or harassing content; or
- otherwise use the Portal in a manner that violates applicable law.
15. Portal Availability; Changes
Arizona Pain may modify, suspend, or discontinue the Portal (in whole or part) at any time. The Portal is provided “AS IS” and “AS AVAILABLE” and may be interrupted for maintenance or due to unforeseen events.
16. Record Retention
Arizona Pain may retain application materials and related records as needed to:
- evaluate your candidacy,
- comply with legal obligations and recordkeeping requirements,
- maintain audit trails, and/or
- resolve, defend, or pursue legal claims.
Retention periods may vary by jurisdiction and circumstances (including legal holds).
17. Disclaimer of Warranties
To the fullest extent permitted by law, Arizona Pain disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement with respect to the Portal.
18. Limitation of Liability
To the fullest extent permitted by law, Arizona Pain will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to your use (or inability to use) the Portal.
If liability is imposed despite this limitation, Arizona Pain’s total liability will not exceed $100 or the minimum amount permitted by law, whichever is greater.
Some jurisdictions do not allow certain limitations; in that case, these limitations apply only to the extent permitted.
19. Indemnification
You agree to indemnify and hold harmless Arizona Pain and its affiliates, officers, directors, employees, and agents from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Portal.
20. Governing Law; Venue (Multi‑State Applicants)
These Terms are governed by the laws of the State of Arizona, without regard to conflict‑of‑law principles.
Any dispute arising from or relating to these Terms or the Portal will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction and venue in those courts.
21. Changes to These Terms
Arizona Pain may update these Terms from time to time. Updated Terms will be posted with a new “Last Updated” date and will apply prospectively to submissions after the update.
